Acceptance
By creating an account, accessing or using SAPHIR, you agree to use the service in accordance with these Terms of Use and applicable law.
If you do not agree with these terms, you must not use the service. These terms constitute a binding agreement between you and the owner of SAPHIR.
Licence of use
SAPHIR grants you a personal, non-exclusive, non-transferable and revocable licence to access and use the service in accordance with these terms.
This licence does not confer any right over the source code, the visual assets, the databases or any component of the platform.
Minimum age
To create an account you must be over 18 years of age or act with the consent of your legal guardian, as confirmed in the registration form.
If we detect an account created without meeting this requirement, we may suspend it until the corresponding consent is proven.
User responsibilities
You are responsible for entering accurate information, keeping your credentials secure and reviewing the information you choose to make visible through the QR or shared access.
You must not upload illegal content, impersonate another person, attack the service, attempt unauthorized access or misuse the emergency features.
You are responsible for any activity carried out from your account, including access by third parties that you have authorized.
Prohibited uses
It is prohibited to use SAPHIR to distribute malware, reverse engineer, extract data from other users, interfere with the availability of the service or circumvent security controls.
It is prohibited to use the QR or emergency access features fraudulently or to obtain information about third parties without their consent.
SAPHIR reserves the right to suspend or terminate access upon any prohibited use detected, without prejudice to any legal action that may apply.
Medical disclaimer
SAPHIR is an information management tool and does not provide medical advice, diagnosis, treatment, triage or emergency response.
In an emergency, users and responders must contact local emergency services and qualified healthcare professionals.
The information contained in your SAPHIR record is indicative and in no case replaces the clinical assessment of a healthcare professional.
Subscriptions, plans and billing
The Free plan has no expiry date. The Basic, Premium and Family plans are billed in advance on a monthly or annual cycle, depending on the option chosen.
You can upgrade or downgrade your plan at any time from Settings → Plan and billing. Upgrades are immediate; downgrades apply at the end of the current billing cycle.
You can cancel the monthly or annual subscription at any time from the billing portal, without penalties. The service remains available until the end of the period already paid.
Payments are processed by Stripe and Visa, Mastercard and American Express credit and debit cards are accepted. SAPHIR does not store card data.
Family accounts and linked profiles
On the Family plan, an administrator creates the account and adds up to 5 additional members, 6 in total, under a single billing.
Each member keeps their own private record. The administrator manages the plan and billing, not the clinical content of the other members.
Anyone who administers linked profiles of relatives or dependants is responsible for having the necessary authorization to process that information.
SAPHIR Assistant and AI limits
The SAPHIR Assistant provides guidance on the data that the user has entered on the platform. It does not diagnose, does not modify treatments and does not handle emergencies.
In an emergency, the assistant refers the user to the local emergency number or to activating the SOS protocol. Clinical decisions always rest with a healthcare professional.
Paid plans include a limited number of assistant queries per billing cycle, as indicated on the pricing page.
Telemedicine
The telemedicine module provides the technical channel for video consultations. The care relationship is established between the user and the healthcare professional who treats them.
SAPHIR does not provide healthcare nor does it intervene in the content of the consultation, and is not responsible for the clinical decisions taken during it.
The number of sessions included depends on the plan purchased, as indicated on the pricing page.
Limits of the emergency features
The information in the emergency summary is entered by the patient. The declared blood group does not replace cross-matching.
Fall detection can only operate while SAPHIR is open and on screen: when the screen is turned off, the browser stops reading the accelerometer. It does not replace calling for help.
Each plan includes a set number of SOS alerts per billing cycle. Once the quota is used up, automatic alert features may be limited until renewal.
Intellectual property
All content, the interface, the software, the texts, the logos and other elements of SAPHIR are the property of its owner and are protected by applicable intellectual property rights.
Content entered by the user in their medical record is their sole responsibility. SAPHIR does not claim ownership of such content.
Availability and changes
SAPHIR may evolve, suspend, limit or discontinue features when necessary for maintenance, security, regulatory compliance or product development.
We may update these terms from time to time. Continued use of SAPHIR after an update implies acceptance of the updated terms.
Disclaimer of warranties
The service is provided "as is" and "as available", without express or implied warranties of any kind, including uninterrupted availability, accuracy or fitness for a particular purpose.
SAPHIR applies reasonable measures to ensure the availability and security of the service, but cannot guarantee that it will be free of errors or interruptions.
Limitation of liability
To the maximum extent permitted by applicable law, SAPHIR, its owner and its collaborators shall not be liable for indirect, incidental, special, punitive or consequential damages.
This limitation applies regardless of whether SAPHIR has been advised of the possibility of such damages and of the legal theory invoked.
Account termination
Users may request deletion of their account through the available account settings or the official support channel.
SAPHIR may suspend or terminate access when an account breaches these terms, creates a security risk or when required by applicable regulations.
Governing law
These terms are governed by the law in force in the jurisdiction of the service owner.
Any dispute shall be submitted to the competent courts of the applicable jurisdiction, unless otherwise provided by law.
